Legal Question in Family Law in Illinois

Paying For College

My Husband agreed that he and his x should pay for childs college. Is he responsible if the child didn't go to college until a year later. And His son is entitled to go to an indiana college for free. The son refuses, can he be made to go to an indiana college in the courts eye?

Thanks

Re: Paying For College

Your husband SHOULD have filed a motion to emancipate the child when the child had the year off from school. Now that he is enrolled someplace, dad is going to be on the hook for awhile.

The court usually limits the cost to what the in-state schools are currently charging.

I doubt that a court would force a child to go to an in-state school, where it was free, if he had valid reasons for going to another school.

That's certainly an issue that dad can ask the court to decide, however.

Usually the college costs are split according to mom and dad's income shares, though a popular way to do it is to have everyone pay 33.3 percent.

That puts some of the burden on the child also.
