Legal Question in Family Law in Illinois

In the state of Illinois, I thought there was a law 750 ILCS 5/513 that divorced parents were to help with their child's college education expenses. My ex states that law only applies if it was stated in the divorce decree. Is that correct?

No, it does not have to be in the divorce decree, but a Petition for the expenses would need to be filed if not in the divorce decree.

No. You have to go to court to get an order for him to pay however.

You are not prohibited from seeking those expenses now. Contact the attorney who handled your divorce or any other local family law attorney.
