Legal Question in Family Law in Illinois

Terminating parental rights before birth

I am pregnant. My ex and I are not planning on raising the baby together however I intend on keeping and raising the baby myself. Can he and I terminate his rights to the baby before the baby is born or do we have to wait?

Re: Terminating parental rights before birth

You have to wait, since you cannot prove the child is his until then. The courts do not like to do amniocentesis, which is the only was to DNA test unborn children. Also, since unborn children are not considered people, there is no real rights he has to terminate until the child becomes a person at birth.
