Legal Question in Family Law in Illinois

visitation abuse?

When a NCP continues to not pick up child at schedule visitation time of 5pm calls states he will not be there until 7pm 7pm comes and goes.. Oh sorry I can't make it until 8 or 9. When does enough become enough and is it resonable to request pick up the next morning? The NCP parent states it is his time and he will pick the child up when he is ready to and CP MUST have child ready or the police will be called. When can the CP say enough is enough and the pick up time is to late?

Have you spoken with an attorney about this issue? If you feel that the visitation order needs to be modified based upon a substantial change of circumstances, then you will have to present the proper motion before the court. Regarding involving the police in visitation exchanges, that practice should be avoided if possible. You are both required to comply with the terms of the court order and should follow the specific times stated. If your order does not set specific times you should ask the court to include more specificity.
