Legal Question in Medical Leave in Illinois

I broke my foot at home. MD has said I can return to work as long as i ambulate with the walking boot. My employer will not allow me to come back to work wearing this boot. I am a nursing supervisor and am mostly in my office but they still won't let me come back. I have already used all vacation and sick time as they have told me. I have to more income coming in from them and I still have approx. 6 wks to wear this boot. I have another company willing to let me work for them wearing this boot. Can i leagally work somewhere else while on FMLA if my current company won't let me work?

The answer to your question requires a thorough analysis of your precise medical situation (to determine if you are protected by the ADA and entitled to reasonable accommodation at work). Further, the answer to the FMLA question requires an analysis of your exact restrictions and if your employer has a policy prohibiting working elsewhere while on FMLA. Consider contacting a qualified employment attorney to assist you with this analysis.
