Legal Question in Civil Litigation in Illinois

How do I collect from auto accident

I own a small limo company. One of my drivers was broadsided by another driver delivering newspapers. Police cited the other driver. Other driver's insurance company denied the claim because he was delivering newspapers as a business and that was not covered in his policy. I don't want to file a claim with my insurance company. Amount of loss about $6000. What are my options?

Re: How do I collect from auto accident

None other than filing a lawsuit against the person who is at fault or filling a claim with your own insurance company or paying out of pocket, you have no other choices.

If the other driver's insurance company claims that they do not cover the car because of their business escape clause, you have to accept it--unless you want to spend a lot of money, probably more than the damage you have, in bringing a declaratory action in court and hoping that they would side with you in forcing the insurance company to provide coverage-A result that is highly unlikely.

If you really do not want to file a claim against your own insurance company, you may simply have to pay out of pocket...

I hope this helps,
