Legal Question in Civil Litigation in Illinois

Idenity Theft

I went to a loan store to pay my loan. I left my drivers liscense there. I went back to the store about two days later to ask for it back. They said they called me about me about. They could not find it any where. One of the girls that worked there looked really scared. I was upset because how could it be there one minute then not next. I kept going back for it but they could not find. I think that one of those girls either took my DL because I was 21 or because some of them were illegal ailens because I have an hispanic name. This was in December 2002, it was right before New Years Eve So i needed a DL,I went and got a new one. Last week I recieved a letter in the mail saying that i missed a court date. It said if i didn't show up to the next court date my bond will be forfeited and there will be a warrant for my arrest. I went to the police station to find out what happened, Some girl got pulled over On Feb. 17 in a car that was not mine and gave my DL. Now I have a record for not showing up to court and an accident showed up on record that I was never involved in. I would like to know what kind of a lawyer should i use or what legal actions should i take.

Re: Idenity Theft

You need an attorney to represent you for all of these issues because it is complex and could leave a scar on your record if you don't deal with it correctly the first time. Be sure you do not miss the next court date.

Re: Idenity Theft

You need someone to represent you in the proceeding involving the accident and someone to represent you in a suit regarding your stolen identity.

Regarding the former, you will need someone to find out what it is you are charged with . . . whether a mere ticket or something more serious like leaving the scene of an accident.

Regarding the latter, you will need someone to go back to the "loan store" to obtain a list of employees so as to conduct an investigation as to your identify theft. In that regard, you may also have a claim against the "loan store" if it acted negligently in protecting your identify.
