Legal Question in Civil Litigation in Illinois

The mother of my child filed a false report stating that I am "armed, dangerous, and suicidal" in order to keep me from seeing my daughter and having no contact.

Is there anything I can do about this once it is thrown out by the judge? I had to take time off work, get legal consultation, visit a psychiatrist and licensed clinical counselor and have suffered emotionally without knowing where my daughter is or how she is doing.

Hello. You can certainly file a slander lawsuit against your child's mother, but this must be done within 1 year. If not, you will be barred from filing the lawsuit by the statute of limitations. It appears that your child's mother is attempting to alienate your child from you. This is a very serious matter. You certainly should have legal representation. If you have been legally declared your child's father, then you should file a motion in court for regular visitation rights to see your daughter. Again, you should have legal representation when filing this motion and proceeding to court. If there is already a court order granting you visitation with your child, a lawyer on your behalf should file a motion asking that your child's mother be held in contempt of court for violating the terms of the visitation order. This is the solution to your problem, but it is important that you take immediate action. Will be happy to answer

any additional questions on this subject that you may have.
