Legal Question in Civil Litigation in Illinois

can a restaurant charge a gratuity on a take out order? the menu says "18% gratuity added to parties of 6 or more". they don't know how many people are in the party for a take out order.

I would suggest that their may be a decptive practice claim available to you. You should review the Illinois Consumer Law Statute.
