Legal Question in Civil Litigation in Illinois

Small Claims

I was recently served with a summons for a debt that dates back to 1994 a written contract. The company has never persued the collection until now by selling it off to third party. I would like to knoe my recourse when I appear for a bench trail.

Re: Small Claims

The statute of limitations for written contracts in IL is 10 years, meaning that they cannot successfully sue you after 10 years. However, some acts such as making a payment extend the timeframe, so you should consult with an attorney about your situation if enough money is involved to be worth the effort.
