Traffic Accident Lawsuit

Two years ago I was at fault in a traffic accident. This evening I was served with papers for 50,000 dollars naming me as a defendent. Can he do this or does he have to sue my insurance company?

This is the normal procedure to initiate a lawsuit, and you should simply contact your insurance carrier for instructions on who to send the suit papers to for further handling. The insurance company will hire a defense attorney, and you will be contacted and represented by that attorney. Obviously he can do it because you have been served with papers. In Illinois you cannot sue the insurance company; however, you should forward the paperwork you have received to your insurance company so that they can provide you with a defense as they are obligated to do under your insurance contract. Also, remember that you are entitled to get your own attorney if you feel that the insurance company's attorney is not providing you the representation you are entitled to... After all, know that the insurance company lawyer know s which side of the bread is buttered...
