Legal Question in Health Care Law in Illinois

Mentally Disabled Parent

What should we do if our parent is hospitalized with schizophrenia and she can not make decisions for herself to care for herself anymore. she thinks she can but we know she can't even pay her own bills or feed herself responsibly. The hospital will not tell us anything without her consent. She is angry and will not talk to us, the hospital will not talk to us.

Re: Mentally Disabled Parent

Hello. I can understand the difficulty in caring for a parent who suffers from this condition. I suggests that you open a Disabled Person's Estate with the Probate Division of the Circuit Court in the County in which you reside. Initially the Court will appoint a lawyer, known as a Guardian Ad Litem, to make a visit to see your parent to determine whether they are not competent to handle their personal affairs. If the Guardian Ad Litem makes this determination, the Court will then appoint as guardian the person (family member) who opened the Disabled Person's Estate. I hope my

comments here are helpful and will be happy to discuss this further and in more detail.
