Power of attorney for what? The Illinois statutory form power of attorney is NOT a health care power. Even the health care powers only become "active" if the person is "not decisional" meaning they are usually sedated or medicated or otherwise in a medical state where they can not be lucid and make decisions. The typical route for this kind of situation would be a guardianship, but that requires a probate court proceeding. Be prepared for a fight.
