Legal Question in Immigration Law in Illinois

Immigration

My fiance attempted to enter the US illegally in 2005 but was detained and returned to Mexico during the attempt. Shortly after, he was able to come to the US by illegal means. I am a US Citizen wishing to marry him but have no clue as to what steps to take in order to legalize his status. Would greatly appreciate any advice... thanks.

You must worry about several things:

1. His expedited removal in 2005

2. His illegal reentry

3. His illegal stay in the United States

Do not so anything until you meet with an experienced immigration attorney for a detailed consultation.

First, you must marry him; second, file a petition on his behalf; he must return to Mexico and consular process into the U.S. If he has remained in the U.S. longer than 6 months illegally, he will be subject to having to file a waiver for any unlawful presence here in the U.S. He cannot legalize without going back to Mexico and entering through the U.S. Embassy in either Ciudad Juerez, or Mexico City.
