Legal Question in Immigration Law in Illinois

i've won the dv lottery for 2011. a friend filed on my behalf and did not include the fact that am married with kids. am in the US now with my family. can we all apply for a change in status regardless of the fact that on my entry form for the dv lottery i was single?

No, you can't. If your wife and kids were not included into your DV-2011 entry, they can't apply with you. Even you can be be denied on that basis. In addition, if you are living in USA illegally or 'out of status', you are not eligible for adjustment of status based on being preselected as a winner in DV-2011. Only if you live in USA lawfully on some non-immigrant visa (e.g. work, student), then you might be able to apply for adjustment of status.

I have had lots of clients in the past few years who were able to successfully adjust status based on DV Lottery.
