Legal Question in Insurance Law in Illinois

life insurance

My father passed, I was the sole beneficiary for his life insurance policy. Without my knowledge my sister submitted a change of beneficiary form to the insurance company naming herself as the primary ben. Two months have passed and I got a call from the insurance informing me that they received that form but it was not dated and it was received after the date of death. They will not administer proceeds because it is a competing claim. How can it even be considered a valid claim? Does she have rights to do that or is that fraud?

Re: life insurance

Her claim sounds to be

invalid and fraudulent.

I have handled many

life insurance beneficiary

cases. I am currently

handling a similar case

in federal court.

A "declaratory judgment" action

probably must be filed to

sort this out.

You need to file an interpleader.
