Legal Question in Insurance Law in Illinois

Vehicle Vandalized

Hi,

I work for the City of Chicago and for work park in a lot owned by the City of Chicago. My vehicle was vandalized. What liability, if any, does the City have. I know for a fact that this is a widespread problem in many City owned lots.

Loop and for that reason I can

sympathize with you. The city will

argue that you park at your own risk,

and usually have signs posted with a

similar notice. However, will be happy to discuss this further and in

This question mixes issues of insurance coverage with employer liability and negligence.

Even though the city is your employer it is fact specific if your parking in their lot was part of your employment. Also, what degree of care they were required to take and indeed did take at the lot depends on facts not presented with this question.

In any event, you should be able to make a claim on your own insurance. The insurance companies are in a good position to know the liability laws and if your insurer can recover from the city's insurer they will.
