Legal Question in Intellectual Property in Illinois

Copyright & Naming Rights

I am creating a new clothing line where we would like to use variations and caricatures of team logos in professional and college sports. Also, we would like to use nicknames of professional and college sports athletes. Do we have to pay for the rights to use the teams logos if they are variations. Also, are we allowed to use the nicknames and not real names of professional and college atheltes without paying them. Thank you for your help.

Re: Copyright & Naming Rights

You absolutely, without a shadow of a legal doubt have to get proper licensing permission to use team logos. Further, you also have to get permission to make variations of team logos and market them, if they would even allow that to happen. You'll need to get a trademark license from the NCAA or other each individual college and/or university. Please they will want to inspect and approve each and every item on which you plan to use their logos (and/or variations.)
