Legal Question in Intellectual Property in Illinois

I have a patent lawsuit in the Court of Appeals for the Federal Circuit and it was dismissed on May 3, 2010. However, few days ago I filed a Motion to Recall the Mandate. If the motion is granted, can I still go to the district court and file a motion to amend new complaint in the district court? If the motion is denied, what should I do next?

This is not a simple question for a bulletin board. It would depend on whether it was dismissed with prejudice or not. Keep working with your current attorney and you will be able to figure your next avenue of attack.
