Legal Question in Employment Law in Illinois

I am employed in Illinois (IL) and was given a signing bonus when i started employment which was under agreement to be repaid if i did not work for the company for 2 years. Additionally, i took vacation before i had fully accrued it. If i leave my employer, my final paycheck would be less than the monies I would technically owe back. 1) Can they deduct advanced vacation and/or signing bonus from my wages in the state of IL and 2) If they can or cannot, for the monies that are unable to be collected from my wages, how can they collect or are they unable to without a lawsuit?

They can deduct the money from your wages if you signed an agreement authorizing such deduction. Further, if the deduction, as outlined by law, is not sufficient to cover the debt owed, they can take you to court to recover what is owed. On a practical note, if you owe them a small sum of money, they are unlikely to pay the costs and fees associated with collection.
