Legal Question in Employment Law in Illinois

Vacation Pay after termination

My husband was separated after 30 days with a company. The starting agreement was one week of vacation from the start. He took one agreed day the 2nd week of employment and his final paycheck said 30 hours remaining of earned vacation time. I thought a final paycheck must have all hours payed out. They are refusing to pay. What are the true facts.

Was there a written agreement? If so, the agreement should provide more information.

If there was no agreement, you may have a claim since the paycheck did state he had unused vacation time. But you need to make sure there was no "probationary period" before the vacation time vests.
