5 Day Eviction Notice

I own a duplex. My daughter and son-in-law and 3 children live in the other side. I have a lease with him for the rent. He has not paid me in almost a year and I want to give him a 5 day notice. I have also paid the gas and electric bills. He has become verbally abusive and my daughter has asked him to leave many times. He says that if I give him a 5 Day Notice then it means that the whole family is evicted and he can take the kids and leave. Is this true? I would like my daughter and the kids to stay as I will be renting the house to her. Thank you.

An eviction isn't the right way to handle this. He's right...they'll remove the whole family's property. If there's legitimate abuse on his part your daughter should seek an Order of Protection and ask for possession of the house.
