Do I have to give my boyfriend an eviction notice or certain amount of time? I live in illinois and own my house. He has lived here for 9 months and things have not worked out. He has mail that comes here. There is no lease agreement. I pay all of the bills and he has helped pay bills when I have asked. Morally I don't want to kick him out on the streets but I know he will not assist with bills until he does move out. I also know he will make it very unpleasant for myself and my children (not his) as long as he is here, so I do not want to assist him till he leaves.

Assuming these are the only facts, the law will imply a month-to-month tenancy so yes your most conservative approach will be to give him a proper 30 days' notice (which an attorney should draft for you because what constitutes "30 days" is not as simple as it sounds), and if he doesn't voluntarily move out, you may have to endure a formal eviction lawsuit against him. If he creates an unsafe situation for your children and you attempt to involve local law enforcement, there is no guaranty they will arrest and remove him.
