Legal Question in Medical Malpractice in Illinois

doctor continuing to prescribe medicine

My brother-in-law had been taking many medications and one of them apparently is known for causing liver problems. The doctor he was seeing had continued to prescribe him medicine after (we think) blood tests came out showing a problem. In (end)November his skin and eyes turned yellow, he went to a new dr. and they told him it didnt look good and wanted him to get an MRI. He did and in (end)Dec. the dr. said he had advanced Cirrosis of the liver. The beg of Jan he was hospitalized for 2 wks to be drained and such. They continued to treat him and also for infection. On February 16th he passed away. I feel the original dr. either didnt advise him to get blood work done and if the doc did and my brother-in-law didnt get it done the doctor should have refused to prescribe him any more meds till he did. Do we have a case? If so now that he has passed how do we get med records without the doctor being aware he passed so he doesnt change the records to protect himself?

It is very likely that there is a case to pursue.

The best thing you can do is to speak to an attorney and have his or her office subpoena the records immediately. There is no easy way to or sneaky way to do this. Falsification of the record is a possibility but usually they are easily noticed and dealt with.
