Legal Question in Medical Malpractice in Illinois

Total Hip Replacement gone bad

I had a THR on my left hip, the dr. that performed no longer at practice, went to new dr. and was told that the angle of the implant is wrong. I have never been happy, it shifts, pops and squeeks. He told me it's not normal and the only way to correct is to repeat the surg. I am only 37. Is there a case?

There may be one, or there may not be. The issue in any medical malpractice case is whether or not the doctor has failed to follow the standard of care. The standard of care allows for somethings to go wrong--because medicine is an art and sometimes things go wrong even if the doctor has been very careful. So, in order to find out whether the doctor was careless and/or failed to follow the proper standard, we have to look at the medical records -- and ALL of it -- and make an assessment of what the doctor has done and why the result obtained.

My office does this sort of cases -- if you want me to properly evaluate your case, I will need you to obtain all your medical records, including all the nurses charts etc.. from before the surgery to after the surgery and all the medical records from the persons who have told you that the angle is wrong etc... I will then have all of it reviewed by a medical expert and see whether you have a case or not.
