Unfinished Circumcision

My son was born 6/24/03 and the doctor that performed the circumcision did a terrible job and never detached the skin completely so it is only 75% done. He said thet it should pull apart b ut it never did and he just turned 3. I am afraid that there may be some damage if I do it now and there will be some costs for the procedure which I already had to pay for and he did not do the procedure correctly. What is my legal stance as far as suing for fees or getting things fixed and getting those fees back?

It is possible that there may be some medical issues that have to be sorted out here. Before talking to an attorney, you should take your son to a doctor to see whether or not there is something that was done wrong--and what are the ramifications of it.

I suggest you go to the same doctor and demand that the job be completed. Tell the doctor that this is unacceptable. You may have a good cause of action to refuse to pay once they charge you for any additional procedures.

It is my opinion that you would be better served trying to resolve this problem as a �customer service� type issue rather than a legal issue.

Perhaps you could return to the hospital where the procedure was originally performed and seek assistance in determining the most cost effective approach - or

While the doctor or hospital may or may not be liable for any damages, it would not be economically feasible to pursue this in court. Until the laws change that provide doctors with privileges, limitations and immunities the rest of us do not have, we are forced to only file lawsuits in cases where the damages are very large.
