Legal Question in Personal Injury in Illinois

auto accident

I was recently in an auto accident. The other driver was at fault. The driver ran a red light and the impact sent my truck on its side, I was brought to the ER, was released later that day with minor injuries. I have since had follow a follow up with my Dr. however I cant go back to work for at least 2 weeks, so by that time it will have been about 3 weeks, What should I do? Also I received a phone 2day from the drivers insurance company,

the women said she was the third party injury claim specialist, that she would like to come to my house and have me sign some papers, she did however say that they are responsible for the accident. WHAT SHOULD I DO?

open to all suggestions and looking for attorney.

Hello. In my opinion you should not sign any papers that the insurance company representative brings to your home. Your inability to work for 2 weeks represents your loss of income claim. First of all you need legal representation to preserve your rights. You should not have any conversations with the other driver's insurance company. I hope you are feeling better. Under no circumstances should you allow the specialist to come to your house or to interview you over the telephone. She is trained by the insurer to say and do whatever is necessary to protect the insurance company and its interest.

You on the other hand are not trained on the proper way to make sure that you obtain full compensation for your injuries which under Illinois law includes medical expenses, past, present and future, disability, disfigurement if appropriate, past and future lost wages and pain and suffering.

The fact that she stated that they are responsible means nothing unless she states it in writing, and even then she can get around that by later stating that she did further investigation that altered her opinion.

You need to hire an attorney as soon as possible to protect your interests.

Hello! My name is Jason Marker. I have personnaly handled many such auto injury cases for clients over the years. I have found it is never a good idea to speak to an insurance adjuster, at least, without a lawyer present. Personally, I dod not completely mind if my clients give a statement to the insurance company - so long as I have spoken to you about the case, advise what to say and not to say, and can be present on the phone during the statement.

I would however, never allow the adjuster to meet with you.

I understand it is very difficult to have injuries that force you to loose time off work. You should know that you will eventually be entitled to be paid for these lost wages. In the meantime, see if your employer has any sort of short term disibility which you could claim. Perhaps you have your own disibility insurance policy you could make a claim under while your off work.

If you are going to be off work for a long enough time, you can file for social security/disibility benefits. It does take time for SSDI to begin however - which is why you may only wish to do this if you know you are going to be off work for months or more.

I am happy to walk you through this process. I tell people all the time that they do not understand how injuries from accidents like this cause so much hardship for people, until it happens to them. We also have relationships with many doctors that can ensure you receive proper medical treatment.

You of course are entitled to all of your medical bills reimbursed, lost time, and an amount of the pain and suffering you experience, which will depend on how significant your injury is.
