Legal Question in Personal Injury in Illinois

My husband was driving along side of a forest preserve (on a street) and a tree fell onto the car.

The weather was fine no rain or wind.

In any case the tree damaged the car.

I only have liablity insurance on the car. (which will not cover the cost of the damage)

Can I file a claim with the county who maintains the forest perserve?

You can, but based on the facts you have presented, it seems very unlikely you will succeed. You would need to show that the forest preserve was aware of a dangerous condition and failed take reasonable actions to correct it. Unless someone made a report that the particular tree which fell was hazardous, you are probably out of luck.
