liability settlement

in january i fell at an establishment which i believe was due to neglicence on their part i had physical therapy for 3 months and did not get any better i saw an orthpeditic surgeon who had a mri done and showed that i had a sprane i did not require any surgery but the doctor said that i will always have problems with my shoulder and still could have a time years later that it could act up and possibly still require surgery. i have asked the insurance company for a pain and suffering settlement over the cost of the bills and my lost wagers for the week that i was absent from work what do you think are my chance of getting any settlement
