Re: personal injury settlement

I see that three lawyers have already answered your question. The two that told you "it depends" were absolutely right.

Cases are regularly, indeed frequently, heard in courtrooms throughout the state where no award was given at all. And soft tissue? You have to PROVE your injury to a jury, and the insurance company knows that. Soft tissue injuries are tough to sell to a jury. And the amount of your medical bills? Well, was that treatment or testing? It isn't hard to have $1900 in testing and diagnostics, and that's not the same as saying you had $1900 in treatment expenses. And physical therapy? It better be ordered by a doctor, or you'll have trouble making it stick. You definetley should see a lawyer. It pays in the long run.

Re: personal injury settlement

The settlement ranges from $3,000 to $10,000 depending on facts, who the doctor is, how the crash happened, how good of a witness you make, how good of a wintess the defendant makes, and how willing are you to take the matter all the way to trial.

Re: personal injury settlement

The settlement range on any personal injury case is contingent upon a great many factors. First, you must establish that the defendant is liable for your personal injuries. We are in a comparative fault state which means that if the jury believes that you were partially at fault for this accident, your recovery would be proportionally reduced. Second, evaluating your damages is contingent upon many factors including how much and how long you suffered, whether you accomplished a complete recovery, whether your activities have been or will continue to be limited and so on. The bottom line is that a lawyer experienced in handeling personal injury claims is in a superior position to evaluate and to attempt to negotiate a settlement of your claim. The more serious your injury, the more important it is to hire an attorney.

Re: personal injury settlement

There really is no settlement range - everything depends on your injuries, your life activities, how the injuries have caused you damage and so many more things that I cannot list them. What I can tell you is that you should have an attorney represent you because an attorney can usually negotiate a better settlement than any person acting on their own because we are familiar with the law. Contact an attorney and you can rest assured know that you are being properly represented.
