Legal Question in Personal Injury in Illinois

My sister was in a car accident in IL in Feb 2006. The other driver's insurance company improperly served me (we have similar names) in OR in May 2008 to an address I no longer lived at. Because of this, my sister missed the court date and a judgement was filed against her in June last year. After checking my credit report, this same judgement also appeared on my credit. Can I sue the insurance company for improperly serving me and messing up my credit and have my sister's case re-opened?�

One thing you can do is to file a Motion with the Court to vacate the judgment that was entered against you. Once vacated, the insurance company will have to report to the credit outfits to remove the judgment against you. There are restrictions and vacating a one year old judgment may not be easy--you may have to retain an attorney to do it for you. You do have a good excuse why the judgment should not have been entered against you.

You can contact your own insurance company or your sisters insurance company as they may provide you with an attorney free of charge. You should be able to vacate the judgment as the paperwork was not served on either you or your sister. feel free to contact me if you have any questions. Good luck.
