Legal Question in Real Estate Law in Illinois

60 day notice to quit

How can address or stop a notice of eviction. This is my house I previously sold to my partner for $1.00 to get a morgtgage on the equity from my house. I have paid all the mortgage payments. I need to know how to go about getting my house back in my name.

Re: 60 day notice to quit

Hello. I hope you had a written agreement

with your parents. In either situation, I am

of the opinion that you will have to file a

lawsuit in Chancery Court which in Illinois is

the Court of equity. Here you would argue that

you have no legal remedy and that the Court

should help you based upon what is fair and

equitable. This is a complicated procedure and

I suggests that you get a lawyer to help you. A

court fight with family members is bound to be

emotional and tiring. There is a check list of

things that you should do. I will be happy to

answer any additional questions you may have.
