Legal Question in Real Estate Law in Illinois

I brought a condo back in july of 2009 and i did nt have a laywer present with me at the time of purchase , but when I signed the deed i was told i was buying a property free and clear of any debt , then once i spoke to the condo ass. i was told that there was a debt of 17,000 $ in ass fees . and they have also rented out the property and told me that the fees gave them the right to the property . i dnt kno what do

You will want to definitely consult with an attorney regarding your circumstances.

I would recommend you speak with Attorney Stephen Messutta. He has a lot of experience

with HOA's.

First, always have an attorney represent you when you buy or sell real estate, ESPECIALLY if someone tells you that you do not need one. Second, who told you the property was "free and clear?" Third, did you receive title insurance? If so, you might be able to make a claim. Fourth, the condominium association has no right to "rent out" the property unless they have properly foreclosed a valid lien.
