Building Permit Issues

We bought a house 3 years ago that was advertised and has a roof deck. The roof has had some leakage issues and when we inquired about fixing the roof we learned that the deck was built out of code and without a permit. So - we are stuck with the prospect of tearing down and not replacing a deck. Do we have any recourse with the sellers, sellers agents or home inspectors. Again - the deck was displayed and the focus of the listing. This was a something unique to the building sold to us.

When you bought the house did you have an attorney? He/she should have caught that on the title insurance report. The attorney should have sent you the title insurance policy. Look there to see if it was on the policy, and cleared. I would need at least that much to determine if you have a cause of action.
