Legal Question in Real Estate Law in Illinois

Deeds / Will

I married my husband after he had bought a home. We have been married for 4 years and I am worried about what would happen to me and 3 kids (mine) if he were to die? My name is not on the house as of yet. Would it go to his next of kin or would it be considered marrital property and I could stay in the home? Would it be wise to place my name on the house? What form would I use to add my name to the home if we were to choose to do so?

Could you use a will in place of a deed? Say leave every thing in trust to me or the kids.

Thank You,

Cindy

Re: Deeds / Will

Your best bet to avoid probate would be a land trust. Give me a call if you have any questions.
