Legal Question in Real Estate Law in Illinois

eviction

How do I get my ex boyfriend to move out of my condo? It's in my name, both title and loan and I've been paying most of the bills for the last 3 years. He refuses to move out.

Re: eviction

There's this guy I know, I can't tell you his real name, but he takes care of things like this.... just kidding.

You will probably need to file a forcible entry and detainer action against him, just as if he was your tenant. Be prepared that he may try to make some claim to the equity in the property.

Re: eviction

He is a tenant. If he did pay things in the past by agreement with you and stopped, there may be an implied contract that he paid rent in that manner and therefore, you can gice him a five day notice and then file for eviction, if not, then you need ot give him a 3o day notice to terminate and then file an eviction if he does not leave.

Good luck

Re: eviction

It doesn't appear that a landlord/tenant relationship ever existed, so I don't believe a forcible eviction is needed. Your ex probably has no right to possession and is therefore probably trespassing. My suggestion is to call the cops and see if they'll do anything about it.
