Legal Question in Real Estate Law in Illinois

My neighbor purchased the lot next to me in February. After he purchased the lot he had a survey done and claims my fence is 10 inches onto his property. Shouldn't that have been addressed prior to him taking posession? The property has already been sold once with the fence there prior to the sale. Do I have to move my fence? We live in New Lenox Il.

Property lines don't necessarily get surveyed before purchase. You have to move the fence, or come to another agreement with the owner.

You may have to move the fence, depending on how long the fence was located where it was.
