Legal Question in Real Estate Law in Illinois

Non-Tenant removal from property

My friend’s mother let a friend of the family who was down and out with no job flop in her basement. He was supposed to get a job and leave after a few months. However, he just lays around all the time and isn’t even looking for a job. She has asked him to leave her home 3 times as she no longer wants him there and he refuses to leave because he has nowhere else to go. He was never a tenant and there is no lease agreement, it was a favor that is now being taken advantage of. Can she just call the police and they will make him get out?Can she just put his clothes and few belongings outside and change the lock?

If you could give me some advice I’d really appreciate it.

Re: Non-Tenant removal from property

Basically, it sounds like he is trespassing. The police SHOULD remove him. However, they will probably refuse if he claims he is a tenant. You will then need to file a forcible entry and detainer complaint against him to have him evicted. Good luck
