Am I still obligated to fix the toilet?

My tenant is past due 1 whole month on rent. He keeps claiming he will pay me next week. I have yet to give him his 5 day notice.

He contacted me today requesting I fix his toilet because it is backed up. Am I obligated to fix it if he does not pay me rent?

Yes. I suggest that you give him the five day notice when you go to fix the toilet.
