Legal Question in Real Estate Law in Illinois

Won't pay commission

The broker has written me checks for my commission and these checks are no good, there are no funds in their account, have been waiting for weeks. The Realtor Board said there's nothing they can do. What can I do? Thank you.

Re: Won't pay commission

There are several approaches. You can contact an attorney to assist you in collecting. You can contact the State's Attorney in your county, since bouncing checks can be a criminal offense. Most larger counties have bad check divisions. You can also contact the Illinois Department of Financial and Professional Regulation. You may be able to contact the Wage and Hour Division, but since you are probably an independent contractor, this might not get you very far. Oh, and even though you are likely aware of this already, you should probably be seeking other employment. Bouncing checks to agents is not a good sign.

You may be able to file an ethics and/or claim for commissions with the Board, although it sounds like you already tried at least one of those approaches. Also, (I believe) you can also sue your broker.
