Legal Question in Real Estate Law in Illinois

Who is responsible for termite inspection in Illinois

I bought a house 3 years ago and just last year had problems and noticed termites. We had the house inspected and come to find out they have been there for more than 10 years. We were not instructed to get an inspection from the loan officer or our realtor. The sellers paid closing costs. Who is entitled to have the house inspected the sellers, the realtor, or the buyers. I know that we should have had the house inspected but as first home buyers we were not told to and never really knew to have it done. I am wanting to pursue legal action is it possible.

Re: Who is responsible for termite inspection in Illinois

The purchaser has the right. Your lender has no responsibility, and generally speaking, neither does the realtor. However under certain circumstances the realtor may have some responsibility.
