security deposit

my girlfriend and i have been living in our apartment

for about 3 yrs. and we were paying 510.00 per month

for rent. now the landlord is raising the rent 80.00

and they say we owe 80.00 to update the security deposit

and 80.00 towards the rent. i have never heard of this

is this legal?

Hello -

If you have a lease, the landlord

cannot change the rent per month

during the term of the lease. If

you do not have a lease, the landlord

can change your rent per month at

the beginning of the month, or before

rent for that month is due, however

he should give you written notice.

Now as to the security deposit, the

landlord, in my opinion, is on shaky

ground. Why does he need to update

the security? I do not think that

he has a right to do this, certainly

under these circumstances. If you

have trouble with him on this issue,

you may want to get representation,

and have your attorney write him a

letter to make inquiry.
