tax claims: children and property

I am in the process of a divorce. The children and I had to leave the home and leave our belongings behind. We left 4-08-06 and have been residing w/ family. I filed for child support and received it since about 09-2006. My husband had court ordered supervision with the children for about 6 months. We had to split the costs.

Can I claim our condo that he is still residing in even though I did not give money towards it in 2007? Can I claim anything for the court ordered supervisiors, lawyers or court costs?

You can not claim condo expenses as tax deductions unless you are paying them.

Child support is not taxable income, but maintenance (alimony) payments are. Be sure that you know what kind of payments are being made to you. The divorce decree should state this.

The legal costs are typically not deductible, but you should check with your tax preparer to be sure (there might be additional information that you have not listed here that would change the answer).
