Legal Question in Traffic Law in Illinois

Driving while License Suspended

I was pulled over for speeding and was arrested for driving without a license. My license had been previouslky suspended for moving violations for 6 months and I was unable to obtain a drivers permit.

My question, Will my license get suspended longer for this, or will I beable to just pay lots of fines.

Also, just because I was caught driving without a license, does it give an officer the right to search my car without my permission??

Re: Driving while License Suspended

If you were to be convicted of driving while license suspended, then there would be an extension of the suspension for an additional six months. If you were to receive court supervision and you successfully complete the supervision, then there would be no extension. This can be a little complicated and it is best to have a traffic attorney assist you.

The police officer can search your vehicle for two reasons. One is a DWLS is a Class A misdemeanor for which you can go to jail for up to a year and as you are being arrested for a crime there is a search incident to that arrest. The second is that the car will be taken into police possession since you cannot drive it, and there is an inventory search to determine what else, if anythng is in the vehicle.
