Legal Question in Traffic Law in Illinois

hit and run

Can I still press charges in Traffic court if I did not see the driver but the owner admitted to who it was? I called and asked the detective asigned to my case and she said no? The driver is identified, by the owner of the vehicle that hit me, not by me or a witness. What do I do?

Hello and Happy New Year. The Assistant State's Attorney is the person who makes the decision as to

what criminal charges will be brought.

That is to whom you should talk with.

The detective has no say in this. He

or she may comment or make suggestions

to the Assistant State's Attorney, but

the Assistant State's Attorney is the

one who brings the charges, not the

police. You may want to consider

filing a lawsuit against the driver

who hit you. Time is of the essence.
