Legal Question in Traffic Law in Illinois

Does he need a lawyer?

My boyfriend hit a pedestrian outside of a crosswalk and received a citation to appear in court. Does he need an attorney? These are the facts: the woman stepped out from between two cars with her back to his car. He hit the brakes but could not stop in time. Due other cars on the road and the time of day, he was not exceeding the speed limit. Nothing has been said as far as the insurance company about her pressing charges, but would it be in his best interest to retain a lawyer?

This could potentially turn into a serious matter. In order to protect him, I strongly recommend that he take an attorney with him to court.

Re: Does he need a lawyer?

He will probably be sued regardless of the traffic case. If he pleads guilty, that's an admission against his own interest and can be used in the civil case against him. If he's founds guilty that can't be used because it's not an admission by him. He should hire a lawyer to represent him.
