Legal Question in Traffic Law in Illinois

How to get other party pay for my car repairs

My family van is hit by a car while we were waiting at signal in Aurora. Clearly she is at falt, as she hit me while I am waiting for signal stop. We exchanged insurance information, but didn\'t call police. Later on I found that the insurance information she provided in not accurate and Allstate is saying that her insurance was terminated few months ago. When I tried to call her she didn\'t answer for at least one day. Then I was able to get hold of her. Now she says she needs a quote so that she can pay. She refused to give her actual insurance information, claiming that she don\'t want to report to her insurance. Now I get estimate for the repairs about $700, she won\'t even answer my calls. She provided her complete address and phone, but never picks up phone. I have a clear evidence that her number plates are imprinted on my van due to impact. I would like to know is this some thing you guys can help. Is this worth persuing or just report to my insurance and get my car repaired. Please suggest.

If you are not at fault, then you have nothing to fear from reporting to your insurance company. This is the reason you paid for insurance, let them reimburse you for repairs and go after the other motorist.
