Legal Question in Traffic Law in Illinois

Speeding in Work Zone

I was caught going 70 mph in a 45 mph Work Zone. I am required to appear in court and face a $395 fine. I was pulled over at 1:00 am and neither I nor my passengers ever saw a posted speed limit for the Work Zone. There were no workers there and it was dark. I didn't even notice the construction because it was on the median and the side of the road; none actually on the highway. I seriously thought the speed limit was 65 mph. I really don't think I should have to pay this hefty fine. What should I do? Do I plead guilty in court and ask for lenience? Do I plead innocent even though I was actually going 70 mph? Can I plea bargain? I want to get this over with on my court date. I don't have time to keep going back. Please advise!

Re: Speeding in Work Zone

The statute requires signs to be placed giving drivers a warning. If you and your passengers did not see any, I would recommend trying to photograph the area. This would be helpful in the event of a trial. You could also use the photographs to make a plea bargain. If the prosecutor believes your story, he may be willing to ammend the ticket to regular speeding.
