Legal Question in Wills and Trusts in Illinois

Access to Bank Records

Father passed away in April and my brother and I are the only beneficiers in the will. Executor is a female friend of my father's who we never got along with. Father won $100,000 in 2002 and has nothing left in his bank account. Executor says he lost it gambling but we don't believe it. We asked the executor to get his bank records from 2002 through date of death. She says we have to get an attorney to file for a court order and would be up to the probate judge whether we get them or not. Is this true or can she get them since she is exector?

Re: Access to Bank Records

The executor can get the documents with her "letters of office." You can try to get them with a subpoena. Call me if you want help.
