Can only an attorney draft a will?

Does a will have to be filed with the county or state?

No. A person can prepare their own Will (at their own risk). However, a non-attorney cannot prepare a Will for another person (unauthorized practice of law).

Will is filed only after the person's death, generally with the clerk of the circuit court in the county where the decedent last lived.
